The Idaho Public Records Law (Idaho Code Section 74-101 through 74-126) grants every person the right to examine and take a copy of the public records of the Idaho Industrial Commission. However, Idaho Code Section 74-105 exempts workers’ compensation records from disclosure, except in certain circumstances. Records Management Request (RMR) forms are used to request information which may be disclosed, and are available for downloading from the web site. The RMR forms are explained below. Our complete public records policy is available online. These forms may be mailed, faxed or sent as email attachments to the Industrial Commission. Forms requiring original signatures/notary must be mailed.
This form is used by PARTIES to an OPEN or CLOSED Idaho workers’ compensation claim. A Party is:
- The injured employee
- The employer
- The surety (insurance company for the employer)
- The Idaho Special Indemnity Fund
- The attorney representing one of the above parties
NOTE: This form may be faxed to the Commission
Request for Workers’ Compensation Records by Parties (RMR-1)
This form is used by Employers and Prospective Employers that ARE subject to the American with Disabilities Act (ADA) Regulations.
NOTE: This form requires a certified signature with a Notary Public Seal.
Employer Certificate and Request for Work History-For Employers Subject to the ADA (RMR-2)
This form is used by Employers and Perspective Employers that are NOT subject to the ADA Regulations.
NOTE: This form requires the Employees Signature with a Notary Public Seal to release the information.
Employer Certificate and Claims History Release – For Employers NOT Subject to the ADA (RMR-3)
This form is the Employee’s Release form to permit other “Non-Parties” to get information.
Note: Examples of who should use this form are:
- An Attorney who is not representing the claimant in an Idaho workers’ compensation claim
- An Employee that wants the information sent to a government agency, such as the Social Security Administration
- Workers’ compensation agencies from other states than Idaho
Claimant’s Request for Personal Workers’ Compensation Records (RMR-4)
This form is used by any member of the public to request a copy of Commission documents other than workers’ compensation records.
Note: Examples of who should use this form are:
- A citizen who wants a copy of the Commission’s budget
- A contractor who wants a copy of a Commission contract
- A member of the media who wants a copy of Commission correspondence
Request for Records – Other than Workers’ Compensation Records (RMR-5)
This form is used by PARTIES to request MICROFILMED workers’ compensation records CLOSED by the Commission PRIOR TO JANUARY 1, 2004.
A Party is:
- The injured employee
- The employer
- The surety (insurance company for the employer)
- The Idaho Special Indemnity Fund
- The attorney representing one of the above parties
