Idaho Industrial Commission 2021 Rulemaking
The purpose of the rule change is to reflect the transition from EDI Claims Release 3.0 to 3.1, which will bring
all prior paper claims into electronic format and change certain aspects of the reporting requirements.

Notice of Public Hearing Regarding Negotiated Rulemaking – Medical Information Proposed Rule Changes
The purpose of these changes are to clarify the right of parties to obtain relevant medical information in workers’ compensation cases, provide a time when that information is due after it is requested, clarify when fees may be charged for providing that information, set the amount that may be charged for information provided, and identify the consequences and remedies for failure to provide relevant information. Additionally, this will consider reducing regulatory burdens regarding electronic payments transfers.

Rulemaking Hearings and Participation
Persons wishing to participate in the negotiated rulemaking must do the following:
Anyone may submit written comments regarding the proposed rulemaking. Oral presentation of comments may be requested pursuant to Section 67-5222(2), Idaho Code, and must be delivered to the undersigned or email@example.com by July 20, 2021.
Upon conclusion of the negotiated rulemaking, any unresolved issues, all key issues considered, and conclusion reached during the negotiated rulemaking will be addressed in a written summary. The summary will be made available to interested persons who contact the agency or, if the agency chooses, the summary may be posted on the agency website.
A public hearing for this rulemaking will be held July 12, 2021 at the Industrial Commission Office located at 11321 W. Chinden Blvd. Boise, Idaho 83714.
It will be made available via videoconference at four Commission field offices across Idaho. The hearing schedule and locations are below.
