Industrial Commission Administrative Rulemaking Process

In accordance with Governor Brad Little’s Executive Order 2020-01: Zero-Based Regulation (ZBR), the Industrial Commission will reduce regulatory burdens by removing costly, ineffective, or outdated regulations. 

Currently, the Industrial Commission is reexamining the Idaho Workers’ Compensation Administrative Rules: IDAPA 17.01.01 – Administrative Rules Under the Worker’s Compensation Law.

As part of the rulemaking process, the Commission will host multiple negotiated rulemaking meetings throughout 2024 to allow Commission stakeholders to share their feedback regarding the current administrative rules and recommend potential changes to improve the effectiveness and reduce regulatory burden.  Members of the public may participate in person or virtually via Webex. The Industrial Commission will provide live streaming of the negotiated rulemaking meetings at designated locations.

Following the conclusion of negotiated rulemaking meetings, the Industrial Commission will hold two public hearings, tentatively scheduled for October 7 and 24, 2024, at the Industrial Commission 11321 W. Chinden Blvd. Building #2, Boise, ID 83714, to receive final public testimony and comments.

Public Comment
The Commission is not currently accepting written comments regarding the Industrial Commission’s rules. Written comments were accepted until October 28, 2024.

Pending Rule

The Commission has concluded rulemaking and adopted a pending rule on November 20, 2024. The pending rule was published in the January 1, 2025 Administrative Bulletin for consideration during the 2025 legislative session.

The purpose of the rule change is to reflect the transition from EDI Claims Release 3.0 to 3.1, which will bring
all prior paper claims into electronic format and change certain aspects of the reporting requirements.

Notice of Public Hearing Regarding Negotiated Rulemaking – Medical Information Proposed Rule Changes

The purpose of these changes are to clarify the right of parties to obtain relevant medical information in workers’ compensation cases, provide a time when that information is due after it is requested, clarify when fees may be charged for providing that information, set the amount that may be charged for information provided, and identify the consequences and remedies for failure to provide relevant information. Additionally, this will consider reducing regulatory burdens regarding electronic payments transfers.

In January, the Governor signed the Red Tape Reduction Act, requiring agencies to cut down on rule sections to make the chapters as simple as possible. To meet the direction of the Governor, the Commission will bring forward rule chapter revisions for when the rules expire on July 1st. These revisions will follow a special process put in place by the Division of Financial Management for final approval by the Governor’s Office. All changes are strictly to consolidate information per the Red Tape Reduction Act. There will be no substantive changes.

Videoconferencing will be available at the Coeur d’Alene, Idaho Falls, Lewiston, and Twin Falls offices for this hearing.
